1.1 No Minimum Quantity Orders: There is no minimum order quantity required.
1.2 Design Services: If the online design tool is not used, a $25.00 design fee will be added to any order that requires a designer to create or modify artwork and email the digital proofs to the client for approval.
1.3 Color Matching: Due to our UV Flatbed printing method, Name Badges, LLC. will not be responsible for exact color matching unless prior arrangements are made using PMS color codes.
1.4 Proof Approval: Please thoroughly examine your online proof before submitting your order. The proof represents how your name badge will appear when submitted to our design team. Modifications can be made to accommodate customer needs.
1.5 Branding on Products: All name badges are pre-printed with our website address on the back for re-ordering convenience. Notify us before submitting your order if you do not wish to have our branded magnets or backings.
1.6 Coupon Codes and Discounts: Any coupon codes or discounts have a maximum of a $30 deduction per order.
2. DELIVERY & SHIPPING
2.1 Processing and Shipping: Name Badges, LLC. will process and ship standard orders within five to seven (5-7) business days (Monday – Friday). Expedited orders will ship sooner.
2.2 Standard Delivery Time: Standard delivery time is 3 to 5 business days after the item has been shipped. Orders to Canada may take longer due to delays at Customs or Canada Post.
2.3 Shipping Methods: All orders are shipped via USPS unless otherwise requested by the customer. Additional shipping charges apply for custom shipping requests. Free standard shipping via USPS is available for all MSRP orders over $200 to the United States and Canada. Custom quoted orders may require additional shipping charges.
2.4 Address Verification: Review your billing and shipping information before submitting your order. Name Badges, LLC. will not be responsible for re-shipping packages at our expense due to missing suite, apartment, or building numbers. If a package is returned, we will contact you and re-ship the package at the customer's expense.
2.5 Shipping Delays: Name Badges, LLC. is not responsible for any delays in shipping once the product leaves our facility. Our responsibility for the shipment of the merchandise ends once it is collected by the carrier.
2.6 Order Inspection: We encourage our customers to inspect their orders upon delivery, prior to any use of merchandise. Contact us immediately if your products are damaged or missing.
3. CLAIMS
3.1 Reporting Missing or Damaged Products: The customer has five (5) days to inform us of any missing or damaged products received upon delivery. After this period, all products will be deemed accepted by the recipient. No claims will be honored after this period.
3.2 Rhinestone Frames Warranty: Due to the delicate nature of our Rhinestone name tags, we offer a 30-day warranty on defects. No claims will be honored after this period.
3.3 Payment Terms: Filing a claim does not alter terms of payment.
4. RETURNS/REFUNDS
4.1 Return Policy: Due to the customizable properties of our products, we can only accept returned items in which there is a manufacturing defect present.
4.2 Complaint Procedure: Customers have 5 days from the date of delivery to issue a complaint by contacting us via email describing the complaint in full, including supporting pictures showing the error.
4.3 Tax Regulation Compliance: Due to tax regulations, we are not able to offer partial refunds.
5. CUSTOMER PRIVACY
5.1 Privacy and Security: Customer privacy and security are of the utmost importance. We do not keep credit card information on file, nor do we share or sell any customer information to third parties.
5.2 Promotional Emails: Promotional emails are often sent to our customers. Notify us if you do not wish to receive these emails, and we will remove your email address from our mailing list.
6. DISPUTE RESOLUTION AND ARBITRATION
6.1 Arbitration Agreement: You and Name Badges, LLC. agree that all disputes, claims, or controversies arising out of or relating to these Terms, the breach thereof, or any use of the Website (including all commercial transactions conducted through the Website), shall be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. This agreement to arbitrate includes all claims that arose before you accepted these Terms, regardless of whether prior versions of the Terms required arbitration.
6.2 Class Action Waiver: You and Name Badges, LLC. agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative action. 6.3 Data Breach Limitation: In the event of a data breach, you agree to hold Name Badges, LLC. harmless and not liable for any damages, losses, or actions resulting from such a breach. You agree that Name Badges, LLC. will not be subject to any lawsuits, litigation, or other legal actions in relation to such a breach.
6.4 Liability Limitation: To the maximum extent permitted by law, in no event shall Name Badges, LLC., its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from the use of, or inability to use, this service.
7. INDEMNIFICATION
7.1 Indemnification Clause: You agree to indemnify, defend, and hold harmless Name Badges, LLC., its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site.
